Welcome to Lovebies.

The terms "Lovebies," "we," "us," and "our" refer to Lovebies. Lovebies operates www.lovebies.com and provides the related website, online store, content, features, products, and customer services (collectively, the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the "Terms"), together with the policies referenced below, explain the rights and responsibilities that apply when you access or use the Services or purchase a product from Lovebies.

Please read these Terms carefully. By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not access or use the Services.

Section 1 — Eligibility, Access, and Accounts

By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you are using the Services with the permission and supervision of a parent or legal guardian.

You may be required to provide information such as your name, email address, telephone number, billing address, shipping address, and payment information. You agree that the information you provide is accurate, current, and complete and that you have the right to provide and use it.

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • Restricting access to your account and devices.
  • Keeping your account and contact information current.
  • Notifying us promptly if you believe your account has been accessed without authorization.

You may not sell, transfer, assign, or license your customer account to another person.

Section 2 — Products and Product Information

We aim to present product descriptions, photographs, colors, sizes, features, prices, and availability as accurately as reasonably possible.

Colors and appearance may vary slightly depending on your screen, device settings, lighting, or manufacturing variations. These reasonable variations do not change your rights if a product arrives damaged, defective, incorrect, or materially different from its description.

Product availability may change without notice. We may discontinue a product or limit the quantity available to a customer, household, geographic area, or order when reasonably necessary, including to prevent fraud, unauthorized resale, or inventory errors.

If a product you ordered becomes unavailable, we will contact you and provide an appropriate solution, which may include cancellation and a refund to the original payment method.

Section 3 — Orders and Order Acceptance

Submitting an order is an offer to purchase products under these Terms. An automated order confirmation acknowledges that we received your order but does not prevent us from conducting payment, inventory, address, or fraud-prevention checks.

We may decline, place on hold, or cancel an order when reasonably necessary, including when:

  • Payment cannot be authorized or verified.
  • A product is unavailable.
  • The price or product information contains a material error.
  • The shipping address is incomplete, unsupported, or cannot be verified.
  • We reasonably suspect fraud, unauthorized payment, unlawful activity, or commercial resale.

If we cancel an order after payment has been collected, we will issue the applicable refund to the original payment method and notify you using the contact information provided with the order.

Please review your order carefully before submitting it. If you need to change or cancel an order, contact us as soon as possible at hello@lovebies.com. We will try to accommodate the request, but changes or cancellations cannot be guaranteed after an order has entered processing or has shipped.

Products purchased through Lovebies are intended for personal or household use and not for unauthorized commercial resale or export.

Section 4 — Prices, Currency, Discounts, and Taxes

Prices displayed on our website are in U.S. dollars (USD) unless otherwise stated.

The price charged will be the price displayed at checkout when the order is submitted, subject to correction of obvious errors. Applicable discounts, taxes, shipping charges, and the complete order total will be displayed before payment is completed.

Lovebies currently offers free standard shipping on eligible United States orders as described in our Shipping Policy.

Prices, discounts, and promotions may change without notice. A price change will not affect an order that has already been accepted, except where the displayed price resulted from an obvious or material error. Promotional offers may have separate eligibility requirements, exclusions, redemption instructions, or expiration dates. If promotional terms conflict with these Terms, the promotional terms will apply to that promotion.

Unless expressly stated, promotional codes cannot be combined or applied after an order has been completed.

Section 5 — Payments and Billing

Payment is required when an order is submitted. Available payment methods are displayed during checkout and may vary depending on the customer's device, location, card issuer, and payment provider.

By providing payment information, you represent that:

  • The payment and billing information is accurate and complete.
  • You are authorized to use the selected payment method.
  • The payment provider may authorize and process the order total.

Payments may be declined or held for verification by Lovebies, Shopify, the card issuer, PayPal, or another payment provider. Lovebies does not control approval decisions made by outside payment providers.

Section 6 — Shipping and Delivery

Lovebies currently ships within the United States according to our published Shipping Policy.

Our standard estimated delivery schedule is:

  • Order processing: 1–3 business days, Monday–Friday.
  • Shipping transit: 6–9 business days, Monday–Friday.
  • Estimated total delivery time: 7–12 business days.
  • Standard shipping cost: Free for eligible United States orders.

Delivery dates are estimates rather than guarantees. Delays may occur because of carrier disruptions, weather, holidays, high order volume, incorrect address information, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. If you identify an address error, contact us promptly. Address changes cannot be guaranteed after an order has entered processing or has shipped.

If a package is delayed, lost, damaged, or marked delivered but cannot be located, contact us with your order number. We will review the available information and assist in accordance with our Shipping Policy and applicable law.

Nothing in these Terms limits rights or remedies that cannot lawfully be limited, including rights relating to products lost or damaged before confirmed delivery.

Section 7 — Returns, Exchanges, and Refunds

Eligible products may be returned or exchanged within 30 days after delivery, subject to our Return & Refund Policy.

For a standard non-defective return, the product must generally be new, unworn, unused, unwashed, unaltered, and returned with its original tags, packaging, and accessories when applicable.

Returns are accepted by mail. Customers are responsible for obtaining a return label and paying return shipping costs for preference-based returns, such as a change of size, color, style, or mind. If a product arrives damaged, defective, or incorrect, contact us before returning it so we can review the issue and provide an appropriate solution.

Lovebies does not charge a restocking fee for eligible returns or exchanges.

After an eligible return has been received, inspected, and approved, the refund will be issued to the original payment method within 3 business days. Payment providers may require additional time to post the refund to the customer's account.

Please review the Return & Refund Policy before mailing a product. Products should not be sent to our business address unless our customer support team specifically confirms that address in the return instructions.

Section 8 — Intellectual Property

The Services and their content, including the Lovebies name, logo, website design, text, graphics, photographs, videos, icons, and arrangement of content, are owned by or licensed to Lovebies and are protected by applicable copyright, trademark, and other intellectual property laws.

You may access and use the Services for personal, lawful, non-commercial shopping purposes. Without prior written permission, you may not:

  • Copy, reproduce, republish, distribute, sell, or commercially exploit website content.
  • Modify or create derivative works from protected content.
  • Remove copyright, trademark, or ownership notices.
  • Use Lovebies branding in a way that suggests sponsorship, affiliation, or endorsement.
  • Use third-party trademarks, images, or content displayed through the Services without permission from the applicable owner.

Shopify's names, logos, products, and services are trademarks of Shopify. Other names, logos, products, and services displayed through the Services may be trademarks of their respective owners.

No license or ownership right is granted except for the limited right to access and use the Services under these Terms.

Section 9 — Optional Tools and Third-Party Services

The Services may provide access to payment options, tracking tools, social media features, applications, or other services operated by third parties.

Third-party services are governed by the applicable provider's terms and privacy policy. We do not control those services and do not guarantee that they will always be available, uninterrupted, secure, or error-free.

Your use of an optional third-party service is at your discretion and subject to the terms imposed by that provider. Nothing in this section limits our responsibility for obligations that Lovebies is legally required to perform.

We may add, change, or discontinue optional features or tools from time to time.

Section 10 — Third-Party Links

The Services may include links to websites or content operated by third parties. These links are provided for convenience and do not necessarily constitute an endorsement.

We do not control third-party websites and are not responsible for their content, security, availability, or privacy practices. If you visit a third-party website or purchase a product or service directly from a third party, please review that party's terms and policies before completing the transaction.

Questions concerning a product or service purchased directly from a third party should be directed to that third party. This does not apply to products purchased directly from Lovebies through our checkout.

Section 11 — Relationship With Shopify

Lovebies is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Lovebies.

By using the Services, you acknowledge that Shopify is not the seller of products purchased from Lovebies and is not responsible for the fulfillment, delivery, return, refund, quality, or safety of those products. To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from your purchase transaction with Lovebies.

Lovebies remains responsible for handling its orders, deliveries, customer service requests, returns, refunds, complaints, and disputes as required by our published policies and applicable law.

Section 12 — Privacy

Personal information collected through the Services is handled according to our Privacy Policy.

Because the Services are hosted by Shopify, Shopify also collects and processes certain information about access to and use of the Services. You can review the Shopify Consumer Privacy Policy for more information about Shopify's processing practices.

By using the Services, you acknowledge that information may be transmitted to Shopify and other service providers, including providers located in countries other than your country of residence, as described in our Privacy Policy.

Section 13 — Reviews, Feedback, and User Content

If you submit a product review, photograph, comment, suggestion, idea, or other content (collectively, "Feedback"), you grant Lovebies a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, display, distribute, and adapt that Feedback for operating, improving, and promoting the Services, subject to applicable law and our Privacy Policy.

You represent that:

  • You own the Feedback or have permission to submit it.
  • The Feedback is accurate and reflects your genuine experience where presented as a review.
  • You have disclosed any material incentive or compensation connected with the Feedback.
  • The Feedback does not violate intellectual property, privacy, publicity, or other rights.
  • The Feedback is not unlawful, defamatory, threatening, abusive, obscene, deceptive, or malicious.
  • The Feedback does not contain malware, unauthorized advertising, spam, or misleading identity information.

We may moderate, refuse, or remove Feedback that violates these Terms or applicable law. We do not guarantee that we will publish or respond to submitted Feedback.

Nothing in this section permits Lovebies to use a customer's personal information or image in advertising without any consent required by applicable law.

Section 14 — Errors, Inaccuracies, and Omissions

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.

We may correct inaccurate information and update the Services. If a material error affects an order after it is submitted, we may contact you for instructions or cancel the affected portion and issue the applicable refund.

We will not substitute a materially different product or charge a higher price without your authorization.

Section 15 — Prohibited Uses

You may use the Services only for lawful purposes. You may not use the Services to:

  • Violate applicable international, federal, state, provincial, or local laws.
  • Infringe intellectual property, privacy, publicity, or other rights.
  • Harass, threaten, abuse, defame, discriminate against, or harm another person.
  • Submit false, deceptive, or misleading information.
  • Impersonate another person or misrepresent your identity or affiliation.
  • Transmit malware, malicious code, spam, phishing messages, or unauthorized advertising.
  • Collect or track another person's personal information without authorization.
  • Interfere with the security, availability, or operation of the Services.
  • Bypass access controls, rate limits, robot exclusions, or fraud-prevention measures.
  • Scrape, copy, extract, resell, or commercially exploit the Services or their content without permission.

We may restrict or terminate access when we reasonably determine that these Terms have been violated.

This section applies if you deploy or permit automated or semi-automated software (an "Agent") to access or interact with the Services.

An Agent must:

  • Identify itself accurately in applicable requests.
  • Not impersonate a human or conceal that an interaction is automated.
  • Not bypass CAPTCHAs, security measures, access controls, robot exclusions, or usage limitations.
  • Comply with applicable laws, these Terms, and reasonable technical instructions.
  • Stop accessing the Services if requested by Lovebies or Shopify.

We may use technical measures to limit or block automated access that violates these requirements or interferes with the Services.

Section 17 — Suspension and Termination

We may suspend or terminate access to the Services if you violate these Terms, engage in suspected fraud or unlawful activity, create a security risk, or misuse the Services.

Termination does not affect payment obligations or rights and liabilities that arose before termination. Provisions that by their nature should continue—including provisions concerning intellectual property, privacy, user content, disclaimers, liability, indemnification, governing law, and dispute resolution—will survive termination.

You may stop using the Services at any time.

Section 18 — Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ONLINE FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

EXCEPT FOR EXPRESS WARRANTIES STATED ON THE WEBSITE OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.

THIS DISCLAIMER DOES NOT LIMIT ANY EXPRESS PRODUCT DESCRIPTION, PUBLISHED RETURN OR REFUND COMMITMENT, OR STATUTORY CONSUMER RIGHT THAT CANNOT BE WAIVED.

Some jurisdictions do not allow certain warranty exclusions, so some or all of the exclusions above may not apply to you.

Section 19 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LOVEBIES AND ITS SERVICE PROVIDERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM USE OF THE SERVICES.

Nothing in these Terms excludes or limits liability when exclusion or limitation is prohibited by law, including liability for fraud, willful misconduct, gross negligence where it cannot be limited, personal injury caused by legally actionable conduct, or mandatory consumer-protection obligations.

Some jurisdictions do not permit certain liability limitations, so those limitations may not apply to you.

Section 20 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Lovebies, Shopify, and their respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from:

  • Your material violation of these Terms.
  • Your unlawful use of the Services.
  • Your violation of another person's rights.
  • Content you submit through the Services.

We will provide reasonable notice of an indemnifiable claim when practicable. You agree to reasonably cooperate with the defense. We will not agree to a settlement that imposes a non-monetary obligation on you without your consent, which will not be unreasonably withheld.

Section 21 — Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed to the minimum extent necessary. The remaining provisions will continue in effect.

Section 22 — Waiver and Entire Agreement

Our failure to enforce a provision of these Terms is not a waiver of that provision or any other right.

These Terms and the policies incorporated by reference constitute the entire agreement between you and Lovebies concerning use of the Services and supersede prior communications or agreements concerning the same subject matter.

Section 23 — Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or other lawful business transfer, subject to applicable law. Any assignment does not reduce rights that cannot lawfully be reduced.

Section 24 — Governing Law and Disputes

These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights or jurisdictional requirements, legal proceedings relating to these Terms or the Services may be brought in the state or federal courts serving Tarrant County, Texas, and the parties consent to the jurisdiction of those courts.

Before filing a formal claim, we encourage you to contact us at hello@lovebies.com so that we can attempt to resolve the issue directly. This informal contact requirement does not prevent either party from seeking urgent relief or exercising rights within an applicable legal deadline.

Section 25 — Changes to These Terms

We may update these Terms to reflect changes to the Services, business practices, or legal requirements.

The current version will be posted on this page with an updated revision date. Material changes will be communicated when required by law. Changes apply prospectively from their stated effective date and do not retroactively alter an accepted order unless required by law or agreed by the customer.

Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
